Building Guidelines

The below information is an extract from contract documentation and presents as per the contractual agreement between seller and purchaser.

CONDITIONS RELATING TO BUILDING
The Buyer acknowledges that the Land is part of a residential development, the object of which is to establish a suitable standard of well designed residential homes. Accordingly, the Buyer hereby covenants with the Seller as follows:

  1. The Buyer agrees to build or allow to remain erected on the Land a single dwelling house (together with car accommodation and, if the Buyer so elects, any usual outbuildings) provided that:
    1. no reflective materials are used;
    2. if fibre cement sheeting is used it must be painted with a textured paint or have a rendered finish; and
    3. such dwelling house shall have a floor area (including car accommodation and verandahs but excluding pergolas and outbuildings) of not less than 150 square metres unless prior written agreement has been entered into with the Seller.
    Please note that in Stage 2A Lots 232, 233, 236, 239, 240, 266 and 267 are multi dwelling allotments and these Building Covenants will not apply to these allotments in so far as the Building Covenants only permit one single dwelling to be constructed and these Building Covenants will be interpreted accordingly.
  2. Subject to the other paragraphs of this annexure, the Buyer will ensure that any dwelling house or other improvements will not be left at any time during construction without substantial work being carried out for a period longer than three (3) months.
  3. No temporary structures are allowed on the Land.
  4. The Buyer shall not allow any rubbish including site excavations and building materials to accumulate on the Land or allow excessive growth of grass or weeds upon the Land.
  5. No caravan or mobile home shall be used on the Land for residential purposes whether or not a dwelling house is constructed on the Land.
  6. Within ninety (90) days of completion of the construction of a dwelling house the Buyer must construct a driveway from the front kerb to the car accommodation on the Land.
  7. The Seller shall have the right to vary (by way of reducing the conditions), exclude or elect not to enforce any of the conditions herein set out in respect of the subject Land or any other Land within the residential estate. The Buyer specifically absolves the Seller from any liability whatsoever for any action taken in varying (by way of reducing the conditions), electing not to enforce or excluding any condition relating to any other lot in the Estate.
